Wallace v. Sajner, et al

Jerry Wallace was a pedestrian hitchhiking from Phoenix, Arizona to Seattle. Jerry was struck by a vehicle going through an intersection as he was crossing the roadway.
The defense contended it was not at fault as the client walked out in front of approaching traffic down the road from a green traffic light. Therefore, there was an issue of liability and comparative negligence.
Fortunately, we were able to overcome the liability issue. We obtained a settlement for Mr. Wallace, short of trial, for $410,000. Mr. Wallace sustained a traumatic brain injury in this accident. Mr. Wallace underwent neurological and neuropsychological testing and was found to have a permanent deficit. Given the fact that there was evidence that our client stepped out in front of a car, this recovery was an excellent result.
