Q. Will my consultation with you be free?
A. Rob Kornfeld offers all potential clients an initial free consultation in person, by phone or through e-mail. Contact us at 1 (800) 282-4878 or email Rob at Rob@Kornfeldlaw.com Otherwise, please feel free to call us to schedule an appointment at our main office or another meeting location during normal business hours. Appointments may also be scheduled in homes, at a hospital or other location for disabled and injured people. We will strive to speak to you in person at another mutually convenient location.
It is not in your best interest to speak to any representative for the negligent party. Do not speak to an insurance company or the claims adjuster. The insurance company has a business interest to maximize your claim and recovery and pay you less. If you wish to speak to the insurance company, talk to a lawyer first to be advised and prepared for questions that likely will be asked. Typically the insurance adjuster will want to take a tape recorded statement. Before giving such a statement , you should be prepared and counseled as to how to answer expected questions. We do not typically suggest you agree to give a recorded statement to any insurance adjuster. Who will pay for my lost wages and medical bills?
This is a difficult question and it varies from case to case. If you are in a motor vehicle accident, your private medical insurance or PIP (personal injury protection) coverage on the vehicle you were in at the time of the accident will pay your medical bills, and perhaps wage loss, up front, before settlement of your claim. If you do not have medical insurance or PIP, the insurance covering the vehicle which you were in at the time of the injury will cover the payment of your medical bills and wage loss. Any other monies owed will be paid out of your final recovery when your case is settled.
Q. What is my case worth?
A. This is a very difficult question to answer because there are many variables and facts which go into this analysis. Confidential communications with your lawyer are privileged. Q. How much will an attorney charge me?
A. Most of our legal services are provided on a contingency basis. This means you will not be charged any fee unless your case is settled. Our fee is based on an agreed-upon percentage of the amount we collect for you. You will still be responsible for any out-of-pocket expenses and these shall be reimbursed to us from your share of the settlement after your claim is finished. Details will be provided to you at your initial client conference.
Q. How do I choose the right attorney?
A. Choose the right attorney carefully. Be sure the attorney you hire practices only personal injury law. My practice is devoted to helping injured people. My firm only handles personal injury law cases for injured persons or victims of other torts.
My advice is to choose an attorney with whom you are comfortable and trust, one who is sensitive, caring and dedicated to helping injured people, and one who will aggressively represent you. It is unlikely that you will find any other attorney who has been through what I have been after my accident in July of 1985. Hire an attorney who has a track record of going to trial, not just settling cases, as insurance companies will settle for more compensation if your counsel has a track record of going to trial. Q. How long will it take for my case to be settled?
A. All cases are different. Settlements vary depending upon the facts and the insurance company involved. There are statute of limitations which govern by when a lawsuit shall be filed. If you do not file a lawsuit in time, the statute of limitations shall time bar any recovery and settlement of your claims and you will recover nothing. These statute of limitations vary. You should consult a lawyer immediately to determine by when your case must be filed or settled.
