Seattle Brain Injury Attorney

Representing Victims of Traumatic Brain Injury in the Greater Washington State Area

Kornfeld Law has decades of experience with traumatic brain injury cases caused by medical negligence, construction accidents, car wrecks or maritime accidents. Brain injuries include aneurysms, intracranial hemorrhages, subarachnoid hemorrhages, strokes, and are referred to as Traumatic Brain Injuries. (TBI). If brain injuries are not treated properly and in a timely manner, the outcomes can be dire.

Kornfeld Law represents victims who have suffered from the following types of brain injuries:

  • Paralysis & Quadriplegia- Paralysis can have a lasting impact on a person's life due to the fact that these types of injuries are often irreversible. Paralysis occurs when nerve cells in the spinal cord are damaged.
  • Permanent Brain Injury- Aneurysms are the result of an artery wall that has been weakened as a result of a serious injury. These injuries are often the result of a healthcare professional's failure to provide quality care.
  • Spinal Cord Damage- Spinal cord injuries may cause paralysis, breathing issues, severe physical pain and emotional distress. All spinal cord injuries lead to severe and lasting effects, and require extensive medical treatment.
  • Vertebral Artery Dissections- Vertebral artery dissections often pose a serious threat to an individual's health, and are often difficult to diagnose. These injuries occur on the back of the neck near the spine and are a result of torn artery walls.
  • Bleeds in the Brain- Any sudden or violent blow to the head can cause serious head trauma and result in permanent injuries. Common symptoms of brain bleeds may include dizziness, headaches, vision issues, convulsions, and many more.
  • Wrongful Death- Losing a loved one as a result of someone else's negligence is one of the most traumatic events to go through. If you are a surviving family member of someone who is deceased due to a catastrophic brain injury, you may be able to seek compensation for your suffering.

What is the Definition of a Traumatic Brain Injury?

According to the Centers for Disease Control and Prevention (CDC), a traumatic brain injury is likely to occur when there is "a disruption in the normal function of the brain that can be caused by a bump, blow or jolt to the head, or a penetrating brain injury."

Some common signs of a traumatic brain injury, or TBI, include:

  • Loss of consciousness
  • Confusion
  • Headaches
  • Dizziness
  • Light or sound sensitivity
  • Nausea or vomiting
  • Insomnia or over-tiredness

Brain injuries are catastrophic not only for the patient, but for their families and loved ones as well. Recovery can take months or years, and in some cases, the victim may never get back to the life they once led. For this reason, it is absolutely crucial for brain injury victims to work with an experienced attorney.

Traumatic Brain Injury Involving Medical Negligence

Rob Kornfeld has extensive familiarity with cases where medical personnel and health care providers failed to timely diagnose and treat intracranial aneurysms and/or strokes.

The medical negligence of primary care providers, family physicians, radiologists and other HMO providers can ultimately cause the brain injury patient to suffer irreversible injuries or wrongful death. When medical staff fails to administer the necessary diagnostic tests, or if they run the tests too late, or read imaging studies incorrectly, their mistakes can alter the life of the patient.

Failure to timely diagnose and treat strokes or aneurysms can lead to intracranial bleeds and cause devastating, life-long injuries, paralysis, cognitive impairment, brain damage and other health care issues for patients and their families. For those who survive these terrible types of medical negligence, cognitive impairment and occupational or vocational disabilities are common and permanent disabilities can occur.

Passionate Advocacy for Brain Injury Victims

Our Seattle brain injury lawyer is passionate about advocating for the rights of his clients, and his first-hand experience with a previous mild traumatic brain injury, all give him a unique connection to the clients he represents who have also suffered a brain injury. Attorney Rob Kornfeld was involved in a serious car accident, in July 1985. Although he fully recovered, he suffered a mild brain injury and underwent five (5) knee surgeries to recover from this traumatic wreck. Rob suffered from post-concussion syndrome and was out of work for several months. During that time, he incurred mounting medical bills and wage loss. Because of this experience, Rob understands what you may be going through. Fortunately, Rob was able to recover and he now devotes his law practice to help other head injury victims and their families to recover from collisions and medical malpractice. Read more about Rob’s story here.

Brain injuries can be expensive to treat, especially if the injury is severe, long lasting, or permanent. Over the past 38+ years, Rob has helped countless families recover the finances necessary to put their lives back together or to care for a loved one after a serious injury. No matter the cause or complexities of the brain injury, Rob helps victims and their families fight for justice to recover damages for medical bills, wage loss, pain and suffering, and disability and all unpaid expenses.

In the medical malpractice arena, whether the negligence was caused by a nurse, hospital, hospital system or doctor, our firm provides the legal support our clients may need to financially and emotionally recover from a brain injury. Whether the medical malpractice incident resulted from an undiagnosed ruptured brain aneurysm, a medical malpractice-induced stroke, a workplace injury, a construction injury, maritime injury, or a motor vehicle accident, we can help you.

The Importance of Timely Brain Injury Treatment

With all brain injuries, a timely and accurate diagnosis is imperative. However, the failure to diagnose and treat an aneurysm before it ruptures is especially crucial. Otherwise, it will lead to catastrophic brain injuries or death. Patients who survive brain aneurysms often experience cognitive impairments and/or disabling injuries. In many cases, individuals with brain aneurysms and a resulting stroke or bleed into the brain are never able to live independently again. When victims come in for treatment, it’s important for the medical facility to run the proper tests as quickly as possible and diagnose the condition right away. Otherwise, a patient who is not timely diagnosed may suffer a permanently disabling stroke and brain damage.

Failure to diagnose an aneurysm is often the result of a health care provider’s inability to recognize the obvious clinical signs and symptoms of an expanding aneurysm or a sentinel bleed. Misdiagnosis or failure to recognize symptoms of a stroke or an aneurysm is usually tied to providers neglecting to timely perform diagnostic tests (MRI, MRA, or CT-arthrogram) and correctly interpret the results. Their mistakes could ultimately cause serious damage and devastation to the injured patient and their family. If you suffered a major brain injury or received poor medical treatment resulting in injury to a family member or loved one, our firm may be able to help you seek justice and to recover the compensation you deserve.
